These Terms & Conditions (“Terms”) govern all bookings, stays, access to, and use of the accommodation known as Anaìs, Paradise Beach, Jeffreys Bay, South Africa (“we”, “us”, “our”).
By submitting a booking, paying any amount, or occupying the premises, you (“guest”, “you”, “your”) confirm that you have read, understood, and accepted these Terms in full.
These Terms apply to all members of your party.

1.1 A booking becomes confirmed only once we issue written confirmation and receive any required deposit or payment.
1.2 Payment deadlines will appear in your booking confirmation. If payment is not received by the required date, the booking will automatically lapse without notice, and we accept no liability for any resulting loss.
1.3 All rates are quoted in South African Rand (ZAR) and include VAT where applicable.
1.4 Unless explicitly stated otherwise, deposits are non refundable.
1.5 Promotional or discounted rates may carry additional conditions, including non refundable terms, which will be disclosed at the time of booking.
2.1 All cancellations or changes must be submitted in writing.
2.2 Unless otherwise stated in your booking confirmation:
• Cancellations more than 30 days before arrival: 100% refund of payments received.
• Cancellations 30–7 days before arrival: 50% refund.
• Cancellations within 7 days of arrival: no refund.
2.3 No shows and early departures are charged at 100% of the total booking value.
2.4 If we must cancel due to force majeure (events beyond our control), you will be offered a date change or refund of payments received. No further liability or compensation will be owed.
2.5 Refunds (where applicable) will be processed within a reasonable period and may be subject to banking delays outside our control.
3.1 The maximum occupancy per unit may not be exceeded under any circumstances. Only registered guests may stay overnight.
3.2 Unregistered daytime visitors must receive prior written consent.
3.3 Parties, events, loud music, or disturbances are strictly prohibited without written permission.
3.4 Breach of house rules—including noise complaints, overcrowding, unauthorised visitors, or illegal behaviour—may result in immediate eviction without refund.
3.5 Smoking is prohibited indoors. Smoking is allowed only in designated outdoor areas. Dispose of cigarette butts responsibly.
3.6 Pets are permitted only by prior arrangement and may be subject to additional cleaning or security deposits.
4.1 You are responsible for the property and its contents from check in to check out. This includes responsibility for all members of your party.
4.2 Any damage, breakage, stain, missing item, or excessive cleaning requirement must be reported immediately and may be charged at the full repair, replacement, and labour cost.
4.3 Charges may be processed after check out once inspection is complete.
4.4 Lost keys/remotes will incur security, replacement, and call out fees.
4.5 Guests must keep doors/windows locked and secure valuables. We do not accept liability for theft, damage, or loss of property.
5.1 All facilities, appliances, stairs, balconies, decks, braai areas, outdoor spaces and surrounding natural environments are used entirely at your own risk.
5.2 The guest assumes full responsibility for the safety and behaviour of all members of their group, including minors, and must ensure children are supervised at all times.
5.3 To the maximum extent permitted by South African law, we are not liable for any:
• injury, illness, allergic reaction, harm or death;
• theft, loss or damage to property;
• slip and fall accidents;
• insect or wildlife encounters;
• ocean related risks including tides, currents, beach hazards;
• weather conditions, natural disasters, or environmental conditions;
• criminal acts of third parties;
• damage caused by misuse or failure to follow house rules.
5.4 We accept no liability for any loss or inconvenience arising from load shedding, water supply interruptions, fibre/internet outages, municipal disruptions, or infrastructure failures, whether foreseen or unforeseen.
5.5 Nothing in these Terms excludes liability where prohibited by law, including for our own gross negligence or unlawful conduct.
5.6 You agree to indemnify, defend and hold us harmless against all claims, damages or losses brought by any third party arising from:
• your breach of these Terms;
• negligence or misconduct by you or your party;
• unauthorised activities or rule violations.
6.1 We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).
6.2 We collect only what is necessary to manage your booking and fulfil legal requirements.
6.3 We do not sell personal information. Data may be shared with third party service providers (e.g., payment processors) under appropriate safeguards.
6.4 You may request access, correction, or deletion of your personal information, subject to legal limits, by emailing info@anaisparadise.co.za.
6.5 By booking, you consent to receive essential communications regarding your stay.
7.1 Guests must comply with posted safety rules (e.g., beach, fire, braai and outdoor equipment safety). Children must be supervised.
7.2 Load shedding, water restrictions and other utility interruptions are common in South Africa. While backup systems may be available, they cannot guarantee uninterrupted service. No refunds or compensation will be provided for such interruptions.
7.3 Natural hazards such as wind, strong surf, dunes, insects, wildlife or slippery surfaces may be present. Guests use all areas at their own risk.
These Terms are governed by the laws of the Republic of South Africa. Any disputes will fall under the jurisdiction of the courts with authority over Jeffreys Bay / Eastern Cape.
